Two certificates, one deduction

For your film or series to generate the article 36.1 deduction and be financed by tax investors, you need two ICAA certificates: the Spanish nationality certificate and the cultural certificate. Without either of them there is no deduction, for you or for the investor.

Certificate What it proves Legal basis Who applies When
Spanish nationality That the work is Spanish because of who makes it: producer, crew, shooting and post-production Art. 5 of Film Act 55/2007 Production or distribution company With the work completed
Cultural That the work has cultural value because of what it tells Art. 22.3 of RD 1084/2015 and Order CUD/769/2018 Production company Together with the nationality certificate

The fact that surprises producers most: both certificates are obtained at the end, once the work is completed. All the tax financing is closed earlier, on the expectation that the certificates will arrive. That is why this guide insists on preparing the project from day one.

Checklist: what the producer and the work need

Go through this list before presenting your project to an investor. Anything that depends on the shoot cannot be fixed later.

The production company:

  • Company or sole trader registered with the Tax Agency, with an office or establishment in Spain.
  • Registered in the ICAA's Registry of Film and Audiovisual Companies or a regional registry.
  • Its own digital certificate (the company's or the sole trader's), the same one used for registration.
  • Up to date with tax and social security (essential if it also applies for ICAA grants).
  • No corporate relationship with the investors who will finance the work.

The work:

  • A certifiable type of work: feature, short or series of fiction, animation or documentary.
  • Rights to the script or original work assigned to the producer and registered in the Intellectual Property Registry.
  • A crew meeting the 75% European nationality or residence rule for authors, actors and technical staff, always with a European director.
  • At least two cultural criteria under article 22.3, one of them content-based.
  • A budget with at least 50% of the deduction base spent in Spain.
  • If it is an international co-production: ICAA approval before shooting.
  • If it is a theatrical film: age rating, requested together with nationality.
  • A copy for deposit with the Filmoteca Española or a regional film archive.

Before you start: the previous steps

The certificates are the end of the road. To get there, the producer must first complete these four steps.

1. Register with the Registry of Film and Audiovisual Companies. It is the gateway to any ICAA procedure. It is done on the Ministry's online portal, the ICAA decides within 15 days and registration in a regional registry is enough. We explain it in detail in our ICAA certificate guide.

2. Always use your own digital certificate. The certificate you register with is the one the Ministry will recognise for every other procedure. Do not register with the certificate of an accountant or representative.

3. Secure the rights to the work. An agreement assigning the script or original work to the producer, and registration in the Intellectual Property Registry. The ICAA will ask you to prove lawful ownership of the rights.

4. If you co-produce with another country, obtain approval before shooting. Applications filed after shooting has begun are rejected. We explain this in our international co-production guide.

Schedule: what to do at each stage

Most mistakes that cost the deduction are made in development and pre-production, long before the certificates are requested.

Stage What to do Why it matters
Development Register the company, secure the rights, check the script against the cultural criteria Without rights and cultural eligibility there will be no certificate at the end
Pre-production Close a crew that meets the 75% European rule, budget on the ICAA template, co-production approval if relevant Crew and Spanish spend decide nationality; a co-production cannot be approved once shooting has started
Financing Sign financing agreements (art. 39.7) with investors The investor contributes before the certificates, so it needs a well-documented project
Shooting Shoot in Spain or the EU (elsewhere only if the script requires it) and document expenses Shooting locations are declared in the nationality application
Post-production Laboratories and studios in Spain or the EU; transcribe the credits Both are included in the application
Work completed Apply for nationality and the cultural certificate; age rating for theatrical films This is when both certificates are obtained
After the certificates Deposit with the Filmoteca and notification to the Tax Agency Completes the requirements for the deduction

The cultural certificate in detail

For tax incentives, the work must meet at least two of these ten criteria, and one of them must be between c) and j). In other words, language and a Spanish setting help, but they are not enough on their own.

Criterion What it requires Type
a) Original version in an official language of Spain; in co-productions, in an official EU language Formal
b) Set mainly in Spain Formal
c) Central plot related to literature, music, dance, architecture, painting, sculpture or another art form Content
d) Screenplay adapted from an existing literary work Content
e) Biographical plot about people of historical or cultural significance Content
f) Mythological or legendary tales, events or characters from any cultural tradition Content
g) Helps to better understand cultural, social, religious, ethnic, philosophical or anthropological diversity Content
h) Plot related to current Spanish or European social, cultural or political affairs Content
i) Aimed at children, with values in line with the Spanish education system or democracy Content
j) Special cultural or social interest for European or Ibero-American audiences Content

How it is justified: in the online application you tick the criteria you meet and write a justification for each one. That justification is what the ICAA assesses, so it deserves the same care as a sales deck.

Example: a Spanish-language documentary about a 19th-century painter meets a) for language, c) for painting and e) for being biographical. Three criteria, two of them content-based: it qualifies comfortably.

Practical tip: check cultural eligibility while the script is in development, not at the end. If the project only meets a) and b), there is still time to strengthen the content.

If you receive a selective ICAA grant: the cultural certificate is issued automatically, without a separate application, because the grants committee has already assessed the project's cultural value.

The nationality certificate in detail

The work is Spanish if it is made by a Spanish production company (or one from another EU country established in Spain) and meets the requirements of article 5 of the Film Act:

Requirement What it requires
Authors At least 75% of the authors (director, screenwriter, director of photography and composer) with Spanish, EU or European Economic Area nationality, or legal residence in those countries. The director must always meet it.
Actors and performers At least 75% meeting the same nationality or residence requirements
Technical creatives and other technical crew At least 75% of each group meeting the same requirements
Language Original version preferably in an official language of Spain
Shooting In Spain or the EU; outside the EU only if justified by the script
Post-production Laboratories and studios declared in the application

Note on the United Kingdom: since 1 January 2021, professionals with British nationality or residence no longer count towards the 75%.

Documents required by the ICAA:

  • Technical and artistic sheet with the nationality of the whole crew.
  • Shooting locations, with justification for any outside the EU.
  • Laboratories and post-production studios.
  • Original version language.
  • Full copy of the work, or of the season's episodes for series.
  • Proof of rights: distribution agreement, registration in the Intellectual Property Registry or other reliable evidence.
  • Literal transcription of the credits.
  • Co-production agreement and authorisation from the other producers, if any.
  • Spanish translation of documents in other languages.

When: with the work completed. For theatrical films, at the same time as the age rating is requested. For series, per season or for the full series, stating the number of episodes.

Watch the legislation: a draft new Film Act would change some of these percentages. Until it is passed, the current article 5 applies.

How to file the applications

Everything is done on the Ministry of Culture's online portal. The old PDF forms are no longer valid.

  1. Log in with the production company's digital certificate, the same one used to register in the Registry of Companies.
  2. Apply for nationality through the nationality certificate procedure and attach the documents listed above. For theatrical films, file the age rating at the same time.
  3. Apply for the cultural certificate through its online procedure, together with nationality. Tick the criteria you meet and justify each one.
  4. Keep the filing receipts with date and time. You will need them to calculate deadlines and, if there is an investor, for its documentation.
  5. Respond to ICAA requests within the deadline given. An unanswered request can lead to the application being closed.

Timelines, silence and what to do if refused

Procedure Maximum time If the ICAA does not reply
Nationality certificate 1 month (2 months for series of more than 20 episodes) The nationality you proposed is deemed granted
Cultural certificate 1 month Check with your adviser; do not rely on silence to close with an investor

Plan with a margin. The ICAA extended by one month the decision deadline for nationality and cultural certificate applications received in May 2026. Extensions may happen again in busy periods.

If a certificate is refused, you can file an administrative appeal with the ICAA itself and then a judicial appeal. Before appealing, check with your adviser whether the issue can be fixed with additional documents.

The cultural certificate can be revoked if it turns out that the criteria that justified it are not met. Justify with real facts, not generalities.

After the certificates: Filmoteca, Tax Agency and investor

With both certificates in hand, three steps remain before the deduction is secure:

  1. Deposit with the Filmoteca: deliver a new copy in perfect condition to the Filmoteca Española or the competent regional film archive.
  2. Notification to the Tax Agency: if there are investors, the financing agreement and the certificates are notified to the Spanish Tax Agency.
  3. Applying the deduction: the investor applies it against its corporate tax, up to 1.20 times its contribution. Any remainder is applied by the producer.

Remember the other tax requirements: at least 50% of the deduction base spent in Spain, grants reduce the base, and the deduction is capped at 20 million per film and 10 million per episode for series. If you combine it with grants, see our guide to grants.

Common mistakes when applying

Mistake Consequence How to avoid it
Hiring a director who is neither European nor resident Nationality is refused, whatever else is met Check the director's nationality or residence before signing
Counting British professionals towards the 75% They no longer count since 2021 and the threshold is missed Calculate the 75% per group with current criteria
Justifying cultural value with language and setting only Content criteria (c to j) are missing and it is refused Secure at least one content criterion from the script stage
Generic cultural justifications Information requests, delays or revocation Concrete arguments linked to the script and crew
Unregistered or broken chain of rights Ownership of rights cannot be proved Register in the Intellectual Property Registry from development
Applying with a different digital certificate Recognition problems on the portal Always use the producer's own certificate
Shooting outside the EU without script justification Risk to nationality Document why the script requires that location
Calculating deadlines with no margin Certificates miss the investor's tax year-end At least two months' margin on the legal deadlines

How TuMecenas helps

The certificates arrive at the end, but tax financing is closed at the start. Our job is to make sure that gap is not a risk for you or your investors.

  1. Early eligibility review: we check the 75% crew rule, the director, the cultural criteria and the Spanish spend before you sign anything.
  2. Certification schedule: we align completion, certificate applications and the investors' tax year-end.
  3. Tax investors: we introduce you to Spanish companies looking for deductions that fit your work's values.
  4. Agreement and Tax Agency notification: we coordinate the article 39.7 agreement and the deal documentation.
  5. Follow-up to the end: we stay with the project until the certificates are issued and the deduction applied.

We are not producers and we do not hold funds: the investor's money goes straight to your production.

Frequently asked questions

Can I apply for the cultural certificate before shooting?

Not for tax incentives. It is requested together with the nationality certificate, once the work is completed. What you can do is check from the script stage that you meet the criteria.

What happens if the ICAA does not reply to my nationality application?

After one month (two for long series) without a reply, the nationality you proposed is deemed granted.

Does the director have to be Spanish?

Not necessarily. They must have the nationality of an EU or European Economic Area country, or legal residence there. It is the only requirement that always applies, with no 25% margin.

Does the certificate work for series?

Yes, for series of fiction, animation or documentary. Nationality is requested per season or for the full series, and the deduction is calculated per episode.

Which works cannot obtain these certificates?

TV programmes, reports, reality shows, sports, live broadcasts, advertising, teleshopping and broadcast theatre or concerts.

Can a distributor apply?

For nationality, yes. The cultural certificate can only be requested by the producer. And the deduction always belongs to the producer.

If I have a selective ICAA grant, do I need to apply for the cultural certificate?

No. In that case it is issued automatically.

Can I close financing with investors before having the certificates?

Yes, and it is the norm. The investor can contribute before or after the expenses, until the nationality certificate is obtained. That is why a well-prepared project is key.
