Why it matters to your clients
If you advise profitable companies, you have clients paying Spanish corporate income tax and looking for legal ways to optimise it. Article 39.7 of the Corporate Income Tax Act lets them finance Spanish films and series and apply a deduction of up to 1.20 times their contribution.
It is a little-known tool with technical requirements that need care. We handle that part so you can offer it with confidence.
What your client gains:
- A gross tax return of 20% on the contribution, around 15% net at the standard rate, since the difference is taxed as financial income.
- A transaction regulated by law, with an agreement and notification to the Tax Agency.
- The chance to associate its brand with cultural works, credited as financier and in its CSR activities.
- No commercial risk: its return does not depend on the box office.
What you gain
- A value-added service for your clients, without having to specialise in the audiovisual sector.
- Projects vetted before they are presented: crew, cultural criteria, rights and certification schedule.
- Documents ready for your review: financing agreement, Tax Agency notification and receipts.
- You keep the relationship with your client and the final say on the transaction.
Partnership programme: client referral agreement
We work with advisers and firms through a client referral agreement: you introduce clients who can benefit from the deduction, and we handle the whole technical process, from project selection until the deduction can be applied.
What the agreement includes:
- Clear terms in writing: the agreement sets out how each client you introduce who closes a transaction with TuMecenas is recognised.
- Your client stays your client: we do not provide general tax advice to your clients or compete with your firm.
- Transparency with the client: your client knows we work together and understands how the transaction works before deciding.
- Shared follow-up: we keep you informed at every milestone of your clients' transactions.
- Material for your clients: guides in PDF in Spanish, Catalan and English to explain the deduction rigorously.
How we work together
- You present the case: you tell us your client's tax profile and how much it could sensibly contribute.
- We propose projects: we select works that fit its tax calendar and, if it wishes, its brand values.
- You review the transaction: we send you the project analysis and the draft agreement to validate with your client.
- We sign and notify: we coordinate signing, the direct contribution to the producer and notification to the Tax Agency within the tax year.
- We follow the project: we keep you informed at every milestone until the certificates are issued and the deduction can be applied.
What we take care of
The deduction depends on the work obtaining its ICAA certificates, which arrive once the work is completed. That is why we review each project before presenting it, and the agreement includes a repayment clause if the certificates are not obtained. We explain this in detail, risks included, in our guide for investors.
We do not hold funds: your client's contribution goes straight to the producer.
Shall we talk?
Tell us what kind of clients you advise and we will explain how the referral agreement works.
Frequently asked questions
Which client profile fits?
Companies, or self-employed individuals under direct assessment, with enough tax liability to absorb the deduction that year and no relationship with the producer.
When must the transaction be closed?
The agreement must be notified to the Tax Agency before the end of the tax year in which the deduction arises. For calendar tax years, before 31 December. The earlier it is planned, the more projects there are to choose from.
How is it accounted for?
The contribution is booked as a right that is cancelled by the deduction, and the difference is recognised as financial income.
Does my client acquire rights in the work?
No. Article 39.7 prevents it: its benefit is purely tax-related.
Do I stop advising my client on this transaction?
Quite the opposite. You review the transaction and give the go-ahead; we contribute sector knowledge and technical management.
Can you give me material to explain it to my clients?
Yes. Our guides are available in PDF in Spanish, Catalan and English.
